I don't consider them sandwiches. A torta is a sandwich.

For purposes of compliance with the regulation, I'd consider them to be a kind of sandwich. For a different purpose, maybe not.

This sounds like one of those situations where there's a silly twist in tax regulations. There have been a few of those in the UK where VAT is applied to "luxury food" but not to "food", leading to lots of fussing over exactly where the dividing line between the two might lie.

If I recall there was a huge fight that went to the High Court over whether Jaffa Cakes should be considered cakes or biscuits. A similar argument took place over exactly how Pringles should be classified.

Until people start asking what the government is doing with the tax money it already takes and maybe wasting less of our productivity instead of clamoring for all the new taxes to land on Someone Else, this sort of thing will continue.
