Mr Trump had claimed in the landmark legal case that he was immune from criminal charges for acts he said fell within his duties as president.

But Tuesday's unanimous ruling in Washington DC struck down that claim.

It is a setback for Mr Trump, who has for years cited presidential immunity while battling multiple cases.

"We cannot accept former President Trump's claim that a president has unbounded authority to commit crimes that would neutralise the most fundamental check on executive power - the recognition and implementation of election results," the three-judge panel from the US Court of Appeals for the DC Circuit wrote in its opinion.

I kind of expect SC to just refuse the case and let this ruling stand. There isn't much of a win for them either way if they do take it.

I agree with the ruling. We have balance of power for a reason. Trump seems to want to do whatever, whenever and however he wants and to be able to get away with things.

On the other hand, we are seeing for the first time in our history a wholesale effort to bring charges against a President or former President (and a slew of other people as well) as a political device. Apparently, the framers of the Constitution were wary of such doings and instead provided impeachment and removal from office instead and under strictly limited conditions.

Given the new interest in bringing contrived charges against a political opponent and his supporters, and the relative ease with which a sympathetic jury and judge can be found, if the president does not have immunity from all but real and very serious charges, we'll descend into the condition that already exists in other countries that are often referred to as "banana republics."

Of course there are people who wouldn't mind if that happened, so long as their party was the one to come out on top.

It is curious to see the same Department of Justice that slow-walked the investigation into Hillary Clinton and her emails so as not to influence the 2016 election, and buried the Hunter Biden issues in 2020 to avoid influencing the election, now going after Trump in 2024 regardless of the influence on the election.

Back in 2021 I read Trump's speech and didn't see anything in it that I considered to be inciting an insurrection. But, you know, orangemanbad so whatever it takes I guess.
