A Southern California motorcycle club founder who killed three people in 1980 has been ordered to be released this week, following a terminal cancer diagnosis, prosecutors said Thursday.

Thomas Maniscalco, 77, has been incarcerated for nearly 40 years after his 1994 conviction on three counts of second-degree murder, with enhancements for being armed with a firearm, according to state prison officials. He was sentenced to life in prison and has been denied parole twice.

He was ordered released under California's compassionate release law, which was amended last year and allows for incarcerated people to be freed if they have a serious and advanced illness with an end-of-life trajectory.

Why show compassion for a triple murderer that showed no compassion for his three victims?

Your thoughts?

I can think of several reasons:

- He's already served nearly 40 years
- He may have outlived his victims, but prison life is not really a "life".
- He's likely to die soon anyway.
- He's still got the judgement of God to look forward to.

I'll assume it's a typo that says "nearly 40 years" since his 1994 conviction.

I guess there comes a point when keeping someone locked up offers no further punishment to them and no further protection for society. If the purpose is to protect society and he continues to be a danger, keep him locked up. If the purpose is simply to be vindictive put a bullet in him and be done with it.

Maybe he's sorry. Son of Sam stays in prison for the family from the victims.
